This is a proposed copyright procedure for legal review. Whether 17 U.S.C. § 512 applies to the eventual operator and particular services remains unconfirmed. This draft does not claim safe-harbor eligibility, a registered agent or an operational notice-processing service.
The following outline refers to the U.S. Copyright Office's official section 512 text. It does not replace professional advice or the statutory requirements.
1. Notice of alleged infringement
The proposed procedure would request the following information for an infringement notice. No verified agent or submission channel is available on this page; do not treat this draft as a functioning filing route.
- A signature, physical or electronic, from someone authorized by the relevant copyright owner.
- Identification of the copyrighted work, or an appropriate representative list for multiple works at one site.
- Identification and location information for the allegedly infringing material sufficient to locate it.
- Contact details sufficient to reach the complaining party, such as address, telephone and available email.
- A good-faith statement that the disputed use is not authorized by the owner, its agent or law.
- A statement of accuracy, and of authority to act for the relevant rights holder under penalty of perjury.
2. Counter-notice
For material removed or disabled by mistake or misidentification, the statutory counter-notice framework calls for the following information. This is a description for review, not an invitation to submit through an unverified channel.
- The subscriber's physical or electronic signature.
- Identification of the affected material and its location before removal or disabling.
- A statement under penalty of perjury of a good-faith belief that removal or disabling resulted from mistake or misidentification.
- The subscriber's name, address and telephone number, the required consent to court jurisdiction, and acceptance of service from the original notifying party or its agent.
Under section 512(g)(3)(D), the jurisdiction statement concerns the U.S. federal district court for the district containing the subscriber's address. For an address outside the United States, it concerns a district in which the service provider may be found. It also includes accepting service of process from the original notifier or its agent. This is not a BVI-court consent clause; the provider's identity and where it may be found require legal confirmation.
3. Designated agent
- Agent name and operating legal entity: to be confirmed.
- Postal address, telephone and email: to be confirmed.
- Copyright Office designation and registration status: to be confirmed.
The Copyright Office describes separate public-contact and registration requirements in its designated agent guidance. This page does not establish that those requirements have been met. No notice-handling deadline or submission service is promised here.
4. Repeat infringers
A proposed repeat-infringer policy would address termination of relevant hosted-service access in appropriate circumstances. Its applicability, procedures and implementation must be confirmed before adoption. It would not give the operator control over a user's self-custodied assets.
5. Misrepresentations
Section 512(f) addresses potential damages, costs and legal fees for certain knowing material misrepresentations about infringement or mistaken removal. The statute's conditions and the particular facts matter; this draft does not determine a person's liability.
